Payment Terms

We accept Visa, Mastercard, Interac/Debit Card, and Cash. Unless otherwise stated there is a 10% buyers fee that will be added to your bill as well as 7% GST.

Auction Terms

Full Payment : All items must be paid for in full by Visa, Mastercard, Interac/Debit Card or Cash before the items may be checked out. All sales are subject to Sales Tax Laws, and the 10% buyers fee.

No Warranty: All items are sold without guarantee of any kind unless otherwise stated by the auctioneer, David Galvin. The descriptions of items advertised prior to an auction are believed to be correct, However, neither those descriptions nor any oral statement made by the owner (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied. The bidder is to examine and inspect the merchandise during the viewing and accept it the way it is.

Disputes: The Auctioneer shall designate the winning bidder after each item is auctioned. If a dispute arises , the Auctioneer reserves the right to reopen the bidding. The Auctioneer's designation of a buyer shall be final.

 

Conditions of Sale

1. All parties bidding at the sale shall be held to have informed themselves as to the regulating conditions.

2. The Auctioneer shall have the power to regulate the bidding. The Auctioneer has the right to refuse any bid and to advance the bidding at his absolute discretion, and to not sell any article should he feel the highest bid to be injurious to the consignor.

3. The lots, immediately on being sold are held as delivered, and remain at the purchaser's risk.

4. All parties bidding at the sale shall be held to have satisfied themselves as to the identity and condition of any lot or lots bid for, and shall be precluded from raising any objection thereto after the sale of the lot or lots in question on any ground whatever.

5. The lots are to be paid for and removed whether genuine and authentic or not, with all errors of description and faults at the buyer's risk, vendor or Auctioneer not being responsible for authenticity, genuineness, or correctness of description, and fault or defect in any lot or lots, and making no warranty whatever. The only exception to the above is that we guarantee the authenticity of all art sold. If within 10 days of date sold a piece of art proves not to be the work of the artist described in the catalogue (acceptable proof being the written opinion of 2 recognized independent experts) the purchase price shall be refunded so long as the art work is returned within 10 days in the same condition as it was sold. This guarantee expires after the above mentioned 10 days.

6. All lots must be paid for in Cash, Interac/Debit card, Visa, Mastercard, Certified funds, and taken away immediately after the sale, or arrangements made for pickup. 10% buyers fee and 7% GST will apply.

7. Failing compliance with the above, all uncleared lots will be resold, either by public or private sale and without any further notice whatever to the purchaser, who shall make good any deficiencies arising thereon.

8. All matters of dispute must be immediately submitted to the Auctioneer, whose decision in all cases, is final.

9. No Guarantees or Warranties offered or implied by any remark or comment by the Auctioneer, or any of his employees with regard to any item.
